Release of Information Acceptance:

By proceeding with this request, you are authorizing New Jersey Department of Community Affairs, Emergency Rental Assistance Program and its agents to verify the information you provide with the Internal Revenue Service (IRS) and/or other third-party systems for identity verification and fraud avoidance.

Landlord:

attests that Landlord is owner of the Property, property manager, broker, or otherwise possesses the legal standing and authority to enforce the terms of the Property lease, and that Tenant and Landlord have a valid landlord/tenant relationship, wherein Tenant does not own or have any interest in the Property.
agrees to provide documentation upon request, including a W-9 form, as necessary to obtain disbursement of funds or as required for compliance monitoring or audits.
attests that lease information and period is true and correct to the best of your knowledge.
attests that Tenant occupies the Property as their primary residence to the best of your knowledge.
attests that Landlord has not received any other federally funded rent relief or other assistance specifically benefitting Tenant or Landlord for the Property during the SC Stay Plus Program assistance period.
affirms under penalty of perjury that the facts set forth in these statements are true and accurate.

As a condition of accepting SC Stay Plus Program funds, Landlord:

agrees to properly apply SC Stay Plus assistance to Tenant rent and remit any additional SC Stay Plus assistance not applied in the manner to SCSHFDA. In the following order, Landlord:
agrees to extend the Lease if necessary for the period that the SC Stay Plus Program assistance covers. If SC Stay Plus rental assistance covers only a portion of, or pro rata, rent for a month, the lease may not end until the end of that month.
agrees to not charge any additional late fees, penalties or charges (outside of rent) after the execution of the landlord tenant agreement.
agrees to provide Tenant with a statement of accounting for the application and award of SC Stay Plus assistance to Tenant’s rent owed.
agrees that SC Stay Plus assistance may only be applied to rent and fees established by the lease while Tenant resides at the Property.
agrees to not increase the rent or fees during the duration of the SC Stay Plus assistance period.
agrees to ensure, in the event that the Landlord no longer owns the property or if the lease is assigned to another, that the application of SC Stay Plus rent assistance and protections under this Agreement continue for the period of the lease as governed by this Agreement.
acknowledges that the SC Stay Plus Program is for the benefit of Tenant, and all provisions of this agreement shall be read in favor of furthering the goals of the SC Stay Plus Program to prevent evictions and provide housing stability.
expressly acknowledges that this AGREEMENT IS AN EXPLICIT ADDENDUM TO THE LEASE BETWEEN LANDLORD AND TENANT. If there are inconsistencies between the lease and this addendum, the terms of this addendum prevail. This shall be read as an attestation and obligation of Landlord as a condition of receiving SC Stay Plus Program funds, so that even if this addendum is prohibited to be incorporated by law, that the effect is the same.

Oral Leases

If there is no written lease between Landlord and Tenant, this agreement shall serve as a written lease agreement between Landlord and Tenant:

ALL provisions contained in this Agreement apply to Lease.
TERM: The term of the lease must coincide with any SC Stay Plus assistance covered period.
RENT: The rent amount shall be the same as the current rent amount.
NOTICE: Parties must provide 30 days’ notice to terminate lease, except that Landlord shall not begin eviction or termination proceedings against Tenant during the term of the lease.

Rights and Responsibilities of SCSHFDA and the SC Stay Plus Processing Agency

Landlord and Tenant acknowledge that the South Carolina State Housing Finance and Development Authority (SCSHFDA) and its designees may exercise whatever remedies available to seek repayment or recover SC Stay Plus assistance from Landlord or Tenant, as appropriate and at SCSHFDA’s discretion, if there is an error in calculation of the assistance, misapplication of funds, where there is a violation of SC Stay Plus program policies, breach of this Agreement, and/or fraud, waste or abuse is committed by the Landlord or Tenant. Landlord and Tenant acknowledge that the designated SC Stay Plus Program Processing Agency and SCSHFDA make no representation or warranty regarding the condition of any property or rental unit for which SC Stay Plus Program funds or assistance is received. The issuance of SC Stay Plus Program funding on behalf of any tenant to any landlord or property owner should not be construed as the designated SC Stay Plus Program Processing Agency’s or SCSHFDA’s acceptance of any property condition(s) or approval of the terms of any lease that has been provided as a part of the application. SCSHFDA and the designated SC Stay Plus Processing Agency further have no liability or responsibility in enforcing the provisions of this agreement on behalf of either party, and shall not pay any other claim by either party to either party. SCSHFDA and the designated SC Stay Plus Processing Agency shall not be required to join any proceedings to enforce the provisions herein against either party.
